By accessing or using QuizThik, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, including any updates provided via the application interface.

2. User Eligibility

You must be at least 13 years of age to create an account. If you are under the age of majority in your jurisdiction, you represent that you have parental consent to use this service.

3. Account Security

Users are responsible for maintaining the confidentiality of their login credentials. Any activity occurring under your account is your sole responsibility.

4. Digital Credits (⚡)

Credits are virtual assets used for AI-powered features. Credits have no cash value, are non-transferable, and are subject to expiration as defined in the Pricing Policy.

5. Communications & Marketing

5.1 You agree to receive transactional emails regarding your account status.

5.2 We may send periodic updates regarding new features.

5.3 You may opt-out of marketing emails via the settings panel.

5.4 Email Marketing & Promotional Syndication: By creating an account, you consent to the use of your registered email for promotional syndication, including the delivery of third-party educational offers and strategic partnerships designed to enhance your learning experience.

6. Prohibited Use

You shall not attempt to reverse-engineer the AI models, scrape the question database, or use the service to distribute prohibited content.

7. AI Accuracy

Our AI tools (OCR and Study Companion) provide probabilistic outputs. QuizThik does not guarantee 100% accuracy in extracted text or academic explanations.

8. Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted access during maintenance windows.

9. Limitation of Liability

QuizThik is provided "as is". We are not liable for any academic loss or data corruption resulting from the use of our tools.

10. Termination

We reserve the right to suspend accounts that violate our community guidelines or engage in credit-fraud.

11. Data Archival & AI Training

11.1 Personal data is encrypted at rest.

11.2 We store a history of your quiz attempts for progress tracking.

11.3 Data is deleted upon account termination request.

11.4 We use industry-standard security protocols.

11.5 User metadata is anonymized for analytics.

11.6 Third-party API providers may process data according to their policies.

11.7 AI Chat & Prompt Archival for Model Fine-Tuning: To improve the accuracy of our AI tutors, all prompts and chat interactions are archived and may be used in an anonymized, aggregated format for the fine-tuning of internal LLMs and the optimization of prompt engineering pipelines.

12. Intellectual Property

The QuizThik brand, UI, and proprietary algorithms are the sole property of the developers.

13. User-Generated Content

Questions uploaded via the Studio are subject to the Crowdsourcing Agreement.

14. Third-Party Links

We are not responsible for the content of external sites linked in our AI responses.

15. Force Majeure

We are not liable for failures caused by global internet outages or cloud provider collapses.

16. Indemnification

You agree to indemnify QuizThik against any legal claims arising from your breach of these terms.

17. Dispute Resolution

Any disputes shall be resolved through binding arbitration in the jurisdiction of the company's registration.

18. The Community Pool

18.1 You may choose to keep your questions private.

18.2 Crowdsourced Question Pooling (Default community sync): By default, all questions generated via the Studio are synchronized with the Community Pool. This allows other students to benefit from your contributions. You may disable this in "Account Settings", but previously synced questions remain in the public pool.

19. Governing Law

These terms are governed by the laws of the jurisdiction in which the service is operated.

20. Severability

If any clause is found invalid by a court, the remaining clauses stay in full effect.
